Terms of Sale & License

These terms cover buying BlueMesa and using it on your Mac. We’ve kept them as short and plain as we can.

The short version

  • $25, paid once. Your license doesn’t expire and there’s nothing to renew.
  • One license covers one Mac. Use it for your own work, including work for your clients.
  • All sales are final, with three exceptions: a charge made in error, a copy that won’t run on a supported Mac, or a refund the law in your country requires.
  • Your data lives only on your Mac. We can’t see it or recover it, so keep backups.
  • Updates within your version are included. Bigger new versions are optional paid upgrades, and the version you have keeps working.

1Who we are and what these terms cover

BlueMesa is made and sold by White Fox Creative, LLC, a Tennessee limited liability company (“we”, “us”). These terms are an agreement between you and us about buying BlueMesa and using it. By buying, downloading, installing or using BlueMesa, you agree to them. If you don’t agree, please don’t buy or use it.

If you’re buying for a business, you’re agreeing on behalf of that business, and “you” means the business.

2Buying BlueMesa

BlueMesa costs a one-time price shown on our website at the time you buy (currently $25 USD). Sales tax or VAT is added at checkout where it applies. There is no subscription and nothing renews.

Checkout, payment, tax and receipts are handled by our online reseller. For those purposes the reseller may be the seller of record, and its own buyer terms apply to the payment alongside these terms. We never see or store your card details.

After you pay, you’ll get an email with your download link and, if your copy needs one, your license key. Please keep that email.

3All sales are final

BlueMesa is a digital download that’s delivered to you right away, so all sales are final. We don’t offer refunds if you change your mind, didn’t use it, or bought it by mistake. Please look at the screenshots, video and system requirements on our website before you buy, and email us if you have a question first.

We will give you a full refund if:

  • You were charged in error, for example charged twice for the same order.
  • BlueMesa won’t run on your Mac, your Mac meets the system requirements shown on our website when you bought, and we can’t fix the problem. Email us within 30 days of buying so we can try to help first.
  • The law where you live requires one. Nothing in these terms takes away rights you have under consumer law that can’t be waived.

If you’re in the EU, the UK or another country with a cooling-off period: you normally have 14 days to cancel an online purchase. For digital downloads that right ends once the download starts, if you agreed to that. At checkout you’ll be asked to agree that your download can begin immediately and that you’ll lose the right to cancel once it does.

To ask for a refund, email team@bluemesa.app with your order number and what went wrong. If something’s wrong with a charge, please contact us before disputing it with your bank. It’s faster, and we’ll put it right.

4Your license

BlueMesa is licensed to you, not sold. When you buy it, we give you a personal, non-exclusive, non-transferable license, with no end date, to install and use the version you bought on one Mac that you own or control. You can use it for any lawful work, including paid work for your clients.

If you replace your Mac, you can move BlueMesa to the new one. Remove it from the old Mac when you do. If you want to use BlueMesa on more than one Mac at the same time, buy a license for each one.

You may not:

  • share, sell, rent, lend or give away your copy or your license key;
  • copy BlueMesa except for installing it under this license and making ordinary backups of your Mac;
  • reverse-engineer, decompile or modify it, except where the law allows you to despite this restriction;
  • get around any license check, or remove our copyright or trademark notices.

5Updates and new versions

Your license covers the version you bought. Updates we release within that version (for example 1.1 or 1.2 if you bought 1.0) are included at no extra cost.

We may release a major new version (for example 2.0) as an optional paid upgrade. You never have to upgrade: the version you have keeps working. We aren’t required to release updates, and we can’t promise that an older version will keep working on every future version of macOS.

6Your data

Everything you put into BlueMesa, including clients, projects, to-dos and time records, is stored only on your Mac. You own it. We don’t have access to it and can’t recover it if it’s lost.

That means backups are up to you. Time Machine or another backup of your Mac covers BlueMesa, and you can export your data to CSV at any time. If you connect Apple Calendar, BlueMesa reads your calendars through macOS on your Mac, only after you give permission. See our Privacy Policy for more.

7What BlueMesa is (and isn’t)

BlueMesa is a planning tool. It suggests how to spread your work across your days and adds up the hours you track. You’re still responsible for your own deadlines, the commitments you make to clients, and checking that the hours you bill are correct. BlueMesa doesn’t send invoices and isn’t accounting, tax or legal advice.

8Ownership

BlueMesa, including its code, design, name and logo, belongs to White Fox Creative, LLC and is protected by copyright and trademark law. Apart from the license in these terms, you don’t get any rights in it.

BlueMesa includes open-source components that are licensed under their own terms. Those licenses are included with the app, and nothing in these terms limits your rights under them.

9No warranty

We work hard to make BlueMesa reliable, but it is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that BlueMesa will be free of errors or will never lose data.

Some places don’t allow these warranties to be excluded. If you live in one, the exclusions above apply only as far as your law allows.

10Limits on our liability

To the fullest extent the law allows, we aren’t liable for any indirect, incidental, special or consequential losses, or for lost profits, revenue, business or data, arising from your use of BlueMesa or from being unable to use it. Our total liability to you for anything related to BlueMesa is limited to the amount you paid for it.

These limits don’t apply where the law doesn’t allow them, for example liability for death or personal injury caused by negligence, or for fraud.

11Ending the license

You can stop using BlueMesa at any time by deleting it. If you break these terms, your license ends automatically and you must delete your copies. Ending the license for that reason doesn’t entitle you to a refund.

12Governing law and disputes

These terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Tennessee, and you and we both agree to their jurisdiction.

If you’re a consumer living outside the US, you also keep the protection of the mandatory laws of your country, and you can bring a claim in your local courts.

Before going to court, please email us. Most problems can be sorted out quickly that way.

13Changes to these terms

We may update these terms, for example when we release a new version or change how we sell BlueMesa. We’ll change the “Last updated” date at the top when we do. The license for a copy you’ve already bought stays as it was when you bought it, unless a change is required by law.

14Everything else

These terms, together with our Privacy Policy, are the whole agreement between you and us about BlueMesa. If any part is found to be unenforceable, the rest still applies. If we don’t enforce a term straight away, we can still enforce it later. You can’t transfer these terms to someone else. We may transfer them to a company that takes over BlueMesa, and your license continues if we do.

You agree to follow U.S. export laws when using BlueMesa, and you confirm you aren’t located in a country or on a list that those laws prohibit sales to.
